Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your use of ColorChanger at colorchanger.online, including our AI image tools such as the Image Color Changer and Nano Banana 2.1 image generation and editing (together, the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

ColorChanger is an independent service. Nano Banana and Gemini are trademarks of Google LLC. ColorChanger is not affiliated with, endorsed by or sponsored by Google.

2. Eligibility

You must be at least 18 years old to use the Service. Some of the AI models we provide are offered by their developers only to adults, so we cannot offer the Service to anyone under 18.

3. The Service

• The Service lets you change colors in your photos, generate images from text and edit images with text instructions and reference images.
• Results are created by third-party AI models that we access through third-party API providers (see Section 9). AI results can be inaccurate, inconsistent or unexpected, and the same request can produce different results.
• Features, supported models, file limits and output options may change over time. Current limits are shown in the product.

4. Accounts

• You sign in with a supported third-party account, such as Google or GitHub. You must provide accurate information and keep your account secure.
• You are responsible for all activity under your account. Tell us promptly at support@colorchanger.online if you suspect unauthorized use.

5. Credits, Plans and Payments

• Credits: The Service runs on credits. New accounts receive 2 free credits. The credit cost of each action is shown before you confirm it. For example, a Nano Banana 2.1 image costs 2 credits at 1K, 3 credits at 2K and 4 credits at 4K.
• Validity: Free credits and one-time packs are valid for 12 months. Subscription credits are valid until the end of the billing period they were issued for (one month for Pro Monthly, one year for Pro Yearly). Expired credits cannot be used or refunded.
• Failed generations: If a generation fails, the credits for it are returned to your account automatically.
• Free previews and downloads: Until you have made a purchase, Nano Banana 2.1 results are shown as watermarked previews. Any paid plan or pack unlocks full-quality, watermark-free downloads, including for images you generated before purchasing.
• Prices: Current prices are listed on the pricing page. Payments are processed by Stripe. We may change prices with at least 30 days' notice; changes do not affect periods you have already paid for.
• Automatic renewal: Pro Monthly and Pro Yearly are subscriptions. They renew automatically at the end of each billing period (every month or every year) and charge your payment method on file until you cancel.
• Credits on renewal: Each paid renewal adds the plan's credits to your account.
• Cancel anytime: You can cancel at any time from the My Orders page of your account by selecting "Manage subscription". Cancelling stops future renewals; your plan and the credits from the current period remain available until the end of the period you have already paid for.
• Failed payments: If a renewal payment fails, we may retry it. No credits are added for a new period until it is paid, and the subscription may be cancelled if payment cannot be collected.
• Earlier yearly purchases: Pro Yearly purchases made before yearly subscriptions were introduced were one-time payments for 12 months and do not renew.
• Refunds: Purchases are final and non-refundable, except where the law requires otherwise or where these Terms say credits are returned.

6. Your Content

"Your Content" means the images, prompts, color choices and other material you submit to the Service.

• You keep all rights you have in Your Content.
• You give us, and the service providers listed in our Privacy Policy, a limited licence to store, process and transmit Your Content only to provide the Service to you, keep it secure and comply with the law.
• You confirm that you own Your Content or have permission to use it, and that you have consent from any identifiable person who appears in images you upload.

7. Generated Images

• Ownership: We do not claim ownership of the images you create with the Service ("Outputs"). As between you and ColorChanger, you may use Outputs for personal and commercial purposes, subject to these Terms.
• Your responsibility: You are responsible for how you use Outputs, including making sure they do not infringe the rights of others and comply with applicable law and the usage policies of the underlying model providers, including Google's Generative AI Prohibited Use Policy.
• No guarantees: Outputs may not be unique, and other users may receive similar results. Depending on your country, AI-generated images may not qualify for copyright protection. We do not provide legal advice or indemnify you for your use of Outputs.
• Watermarked previews: Watermarked previews are provided for evaluation. Do not remove, crop out or obscure the watermark.

8. Acceptable Use

You agree not to use the Service to create, upload or share content, or to act in a way, that:

• Sexualizes minors or depicts child sexual abuse in any form
• Creates sexual or intimate imagery of a real person without their consent
• Impersonates or depicts a real person in a misleading way, or creates deceptive content intended to mislead people about real events, including elections
• Infringes intellectual property, privacy or publicity rights, including uploading images you do not have the right to use
• Harasses, threatens, defames or promotes violence, hate or self-harm
• Facilitates illegal activity, fraud, scams or the creation of weapons
• Removes or circumvents watermarks, usage limits, credit charges or security features
• Uses automated means to access the Service, resells access, or scrapes, reverse engineers or copies the Service
• Uses Outputs or the Service to develop or train AI models that compete with the Service or the underlying models

We may refuse requests, remove content, suspend accounts or report illegal content to the authorities where we reasonably believe these rules have been broken.

9. Third-Party Services and Models

The Service relies on third parties, including AI model providers such as Google, the API providers that give us access to those models, cloud hosting and storage, sign-in providers and Stripe for payments. Your use of the Service may also be subject to their terms. We are not responsible for third-party services, and a model or feature may become unavailable if a provider changes or withdraws it.

10. Our Intellectual Property

The Service, including its software, design and branding, belongs to colorchanger.online or its licensors. These Terms do not give you any right to use our name, logo or branding.

11. Termination

You may stop using the Service at any time and ask us to delete your account. We may suspend or terminate your access, with or without notice, if you break these Terms or if your use creates risk or legal exposure for us, other users or our providers. Unused credits are forfeited when an account is terminated for breach of these Terms.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties about the accuracy, quality or fitness for purpose of AI results, about uninterrupted or error-free operation, or about the preservation of your files.

13. Limitation of Liability

To the fullest extent permitted by law, colorchanger.online is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or business, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

14. Indemnification

You agree to indemnify and hold harmless colorchanger.online and its team from claims, damages and expenses, including reasonable legal fees, arising from Your Content, your use of Outputs, your breach of these Terms or your violation of anyone's rights.

15. Governing Law and Disputes

These Terms are governed by applicable law, without regard to conflict of law rules. Any dispute will be resolved through binding arbitration where permitted by law. Nothing in these Terms limits rights you have under mandatory consumer protection law.

16. Changes to These Terms

We may update these Terms. We will post the new version on this page and update the "Last Updated" date. If a change materially affects your rights, we will give reasonable notice. Continued use of the Service after changes take effect means you accept them.
